We are just at the very tip of the iceberg when it comes to prosecutions. It takes years before people are brought to justice on financial crimes.

If it's a successful business it's good, if it's not, it's a trap and you should get out and onto the labour market. As the poster above said, talk to your bank and explain the situation. Then try to find a steady source of income which will, at least, service the interest without repayments. The bank should be happy with that since the loan is making them money in any case.

Finally, if it's possible to sell your house and downsize or move into a smaller rented apartment, why not do that? If it's a sinking ship you better get off while you can; avoid getting sucked down by the current.

Due to the increase in foreclosures, many lenders are being flexible with home owners in trouble. Swallow your pride and call your lender, be candid about what you can afford right now. You might be surprised what you can negotiate on your own.

Call anyone else you owe money to also, car loans, credit cards, doctor bills, negotiate it all into smaller, more manageable payments until you get back on your feet.

Good luck.

Don't fall for the sales pitch. The LENDER is in control of whether or not to foreclose, and there is nothing anyone can do to stop them if they choose to do so. They hold a legal contract for payment, plus a lien on the property involved. Both contracts always rule in a court of law.

Scams? true and not true. Well I 'll say you call and talk to your loss mitigator and discuss the forbearance agreement.

You need to write a hardship letter why you are not able to pay the mortgage. You need to show some financial documents to prove you dont' have the money to pay them but all will taken care of soon.. ect..

or sell and move to smaller house. who needs the stress.. ?

I helped many in foreclosure to keep or to sell..
contact me at 1strealsolution@gmail.com

It's called an "escrow account". Basically, you can set up automatic transfers from your checking account to a separate account, and either directly authorize the taxing agency to debit that account, or make arrangements to pay the taxing agency from that account.

You can do that, either in a formal method (a third party, the escrow company, has signature authority on the escrow account), or informally. In either case, you need to recalculate the transfer amount, at least annually, when the property tax statement comes in, to ensure you have enough money in the account.

Pro bono work is seldom if ever offered in transactional law where damages are purely monetary. Cases like that are very time consuming in the first place. Secondly, attorneys who give their time in this way are usually advocating Constitutional claims, childrens' rights or the like where there is some pressing public policy issue at stake.

If the agent/owner/broker did not complete the TIL properly and there is actionable fraud, the first thing you could do is report this to the Department of Real Estate (or whoever regulates agents in your state.) TIL violations, if they are material, often result in recission of the transaction and/or sanctions against the person who violated the law. If you could be more specific about your claim, I might be able to suggest something more specific for you.

While there are probably few lawyers who would take this case on a pro bono basis, there are many who have expertise in this area. Poke around the yellow pages and try to get some recommendations from people in your area. If there are material violations, you will more than likely prevail. But if the irregularities are not serious, you might not. Again, let us know what happened and maybe I can make better suggestions.
